These Terms & Conditions govern the provision of services by Grand Cru Select (“we”, “us”, “our”) and the use of this website. By engaging our services or using the website, you agree to these Terms.
1. Nature of Services
Grand Cru Select provides independent wine advisory services to restaurants and private clients.
Services may include, but are not limited to:
Wine pairing and program guidance
Wine sourcing advice and execution (where expressly agreed)
Auction advisory and bidding support
Wine cellar reviews and strategic recommendations
All services are professional advisory services unless explicitly agreed otherwise in writing.
2. Advisory vs Execution
Our services distinguish clearly between:
Advisory (independent judgment and recommendations), and
Execution (sourcing or acquisition of wine on behalf of a client)
No sourcing, acquisition, or bidding is carried out without:
Explicit client approval
Agreed scope
Defined spending limits
Agreed fees
3. Independence
Grand Cru Select operates independently of producers, merchants, distributors, and auction houses.
We:
Do not sell wine as a merchant
Do not receive commissions or incentives from suppliers
Provide advice free from third-party influence
Any sourcing or execution fee is agreed with the client in advance and transparently.
4. Fees & Payment
Fees are agreed in advance and may include:
Consultation or review fees
Project-based or retainer fees
Success-based sourcing or execution fees (where applicable)
Unless agreed otherwise:
Fees are payable in advance
Preparation time is included in the agreed fee
Fees are exclusive of VAT and third-party costs
5. Advance Client Funds
For private clients, funds may be transferred in advance only for expressly agreed sourcing or acquisition purposes.
Such funds:
Are applied strictly within approved parameters
Are reconciled promptly following execution
Do not transfer market or availability risk to Grand Cru Select
6. Auctions
For auction participation:
All bidding is conducted strictly within agreed client limits
No bid exceeds an approved limit without explicit client confirmation
Auction house terms and conditions apply in addition to these Terms
We are not responsible for the actions, decisions, or terms of third-party auction houses.
7. No Guarantees
Wine availability, pricing, quality, condition, and future value are subject to market conditions beyond our control.
Accordingly:
No guarantees are given regarding outcomes or future performance
All purchasing decisions ultimately rest with the client
8. Limitation of Liability
To the extent permitted by Swiss law:
We are not liable for indirect or consequential losses
Liability is limited to the fees paid for the specific service giving rise to the claim
Nothing in these Terms limits liability for unlawful intent or gross negligence where such limitation is not permitted by law.
9. Confidentiality
All client information is treated as confidential and used solely for the provision of agreed services, unless disclosure is required by law.
10. Website Use
The content of this website is provided for general informational purposes only. We do not guarantee that website content is complete, accurate, or up to date.
11. Applicable Law and Jurisdiction
These Terms are governed by Swiss law, excluding conflict-of-law provisions. The place of jurisdiction is Switzerland, subject to mandatory consumer protection laws where applicable.
12. Amendments
These Terms may be updated from time to time. The version published on this website at the time services are engaged shall apply.
